I have been asked by a large company (not related to federal or state govt)to polygraph two employees that could have possibly "tainted" a drink of another with a substance at the workplace.In my reading of EPPA, it clearly states a economic loss to the business must have occurred. This is not the case here. So if EPPA does not apply here, can the two employees still be asked to take an exam? This case is being handled internally and will not be turned over to a police dept. for investigation. On another issue, does anyone know where I can find a directory listing of which states actually issue polygraph licenses? I have found some states that only require graduation from an approved APA course, but I would like a full run down of states. IP: Logged |

Your reading of EPPA hit it on the head. You cannot run this test. The two employees should not be asked to take the polygraph examinations.

Do not test them. It should be turned over for an LE investigation. Also, check out APA, they list the licensing states. I have a map right by my desk with the licensing states underlined if you are questioning just one state. IP: Logged |
